Is It Legal To Market A Drink With Medicine In It?

say i’m an entrepreneur, and im trying to sell a new kind of soft drink with acetaminophen or iburprofan in it (not enough to cause unwanted side effects of course, because id want people to continue drinking it), but for whatever reason. Can i do this or does this break a law, in the United states.

    That’s illegal unless you get all the appropriate permissions, licenses, inspections, etc, etc, etc, from the FDA.
    Just because those are over the counter medicines, doesn’t mean they are unregulated.
    Energy drinks, on the other hand, don’t have pharmaceuticals in them, they have herb and natural extracts (dangerous as those bay be) and those are far less stringently regulated by the FDA. They must post warnings on the product and describe what’s in it, but that’s about all.

    I would suggest consulting the FDA (Food & Drug Administration; altho considering their lackluster performance, maybe the Food & Drugged Administration) about this. First, a soft drink – as a food – requires some sort of govt supervision for the bottling process and the life. Usually extremely slight supervision. But adding a medicine to the formula brings it within the category of a drug, which gets additional and much stricter govt supervision.
    I don’t expect the govt to approve your soft drink. Primarily because, being a soft drink that supposedly doesn’t taste like medicine, there is a considerable risk of overdosing, especially among children and others who don’t bother to read the label. You may remember the problems that Flintstones Vitamins for kids had, about being mistaken for candy.

    I wouldn’t think so because it’s an over-the-counter type med. I think it’s a great idea!!!! I mean millions of people would rather drink vitamin water, than take vitamins. Why not drink your pain med. I think it’s also something that would catch on quickly too. It’s like, say you have a headache, your only option is to take a pill (that everybody hates doing anyway) You might give them there next option…Drink a great tasteing drink that won’t only hydrate you but also make you feel better!!! As for your question though, I’m not exactly sure, you should go to entrepreneur.com or some other site and find a forum and ask people. Good Luck!!!!

    You would have to obtain the approval of the FDA, yes. The FDA has a schedule of substances it regulates, and so if it appears on there, it falls under regulation. If it doesn’t appear on there, you may use it to create your drink.
    That is how and why herbal substances are sold without approval or evaluation from the FDA. That is how they bypass it. Ibuprofen and acetaminophen are FDA monitored.

    Whoa dude, Don’t get into that kinds of stuff.
    You can’t put stuff in your drinks that will make people coming back unless you keep it a secret, but somebody will test the ingredients and find out very soon after released.
    I’m not exactly sure if it’s legal or not, but people could be alergic and you could get sued. Think about it.

    If it was possible to do then coca cola or Pepsi would have done it by now. Laws are very strict on things like what your taking about. what if someone drinks 5 cans in a day will they overdose? I think you`ll need to think of something less complicated to make your millions.

    I believe it it, but I say this because I know of a lot of drinks that must post drug warnings, side effects, and directions. And these drinks- energy drinks- are available in every liquor store, so…

    you can’t do that in the U.S…it’s against the law.
    Besides which, did you know people are ALLERGIC to the stuff you want to put in drinks…I’d look at medical facts before trying to kill people with a drink.

    Better check with the FDA on that. I’m sure its got to be clearly marked because if someone is allergic to that your best friend better be one hell of an attorney. You know what I mean?
